Selig had laid out this contingency in an August 20 Innovation Advisory Committee address, saying the CFTC would use its existing statutory authorities to begin establishing a regime for crypto-asset markets if CLARITY stalled. He directed staff to explore rules allowing registrants and non-registrant crypto exchanges to be designated as “crypto asset markets” and offer leveraged or margined crypto-asset trading under purpose-fit CFTC oversight. The fallback is an administrative pathway, not a legislative one.
